Please read these Terms carefully before using our Site or placing an order. If you do not agree to all of these Terms, you may not access the website or purchase our products.

1. GENERAL CONDITIONS & ELIGIBILITY

  • By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence.
  • We reserve the right to refuse service to anyone for any reason at any time.
  • You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction while using our Site.

2. PRODUCTS & ACCURACY OF INFORMATION

  • Outboard Motor Specifications: We attempt to display the specifications, horsepower ratings, dry weights, and images of our outboard motors as accurately as possible. However, we do not guarantee that product descriptions, colors, or specifications are 100% accurate, complete, or error-free.
  • Pricing & Availability: All prices are listed in USD unless stated otherwise. Prices and product availability are subject to change without prior notice. We reserve the right to modify or discontinue any product at any time.

3. ORDERS, PRICING, & TYPOGRAPHICAL ERRORS

  • We reserve the right to refuse or cancel any order placed on the Site.
  • In the event that a product is listed at an incorrect price or with incorrect specifications due to a typographical error or vendor error:
    • We reserve the right to cancel or refuse any orders placed for that item, whether or not the order has been confirmed and your payment processed.
    • If your payment has already been processed and the order is canceled, we will issue a full refund to your original payment method.

4. SHIPPING, DURATION, & FREIGHT DELIVERY POLICIES

  • Shipping Coverage: Standard shipping rates and timelines apply to the contiguous United States. Extra fees apply to shipments sent to Alaska, Hawaii, or offshore destinations.
  • Fluid Purging Requirement: All outboard motors are drained of fuel and oil prior to shipping in compliance with US Department of Transportation (DOT) parcel and freight hazard regulations.
  • Transit Durations: Shipping transit times (e.g., 1–5 business days via Parcel Ground, 3–7 business days via LTL Freight) are estimates provided by third-party carriers (UPS, FedEx, LTL Freight) and are not guaranteed delivery dates. We are not liable for transit delays caused by weather, carrier backlogs, or incorrect delivery addresses.
  • Freight & Residential Delivery: Outboards exceeding standard parcel weight limits (typically 150 lbs / 25+ HP) ship via LTL Freight. Delivery to a residential address may incur mandatory carrier surcharges (e.g., Residential Delivery Fee, Liftgate Truck Fee). Customers are responsible for providing an accessible delivery address.

5. PRE-OPERATION RESPONSIBILITIES & BUYER OBLIGATIONS

Before starting or operating any outboard motor purchased through SmallOutboardMotors.shop, the customer explicitly agrees to:

  1. Engine Oil & Lubrication: Fill the engine crankcase with recommended 4-stroke engine oil (or mix 2-stroke oil with gas at the manufacturer-specified ratio) and verify lower unit gear lube level before initial startup. Running an engine without oil voids all warranties.
  2. Cooling System: Ensure the outboard motor lower unit is fully submerged in water prior to starting. NEVER start or run an outboard motor out of water, as this will immediately destroy the water pump impeller.
  3. Mounting: Securely clamp or bolt the outboard motor to the vessel’s transom according to manufacturer guidelines before operation.

6. RETURNS, REFUNDS, & RESTOCKING FEES

  • Return Authorization: All returns require prior written authorization from our support team. Unauthorized returns will be rejected.
  • Return Period: New, unused outboard motors in their original, unopened packaging may be returned within 30 days of delivery.
  • Non-Returnable Condition: Any outboard motor that has been fueled, oiled, installed, or operated in water cannot be returned due to HazMat regulations and used-merchandise restrictions.
  • Restocking Fees & Shipping Costs: Returned items for non-defective reasons are subject to a 15% restocking fee. Original shipping charges are non-refundable, and the buyer is responsible for return freight costs.

7. LIMITATION OF LIABILITY & DISCLAIMERS

  • Warranties: Except as expressly provided by the manufacturer’s limited warranty, all products sold through SmallOutboardMotors.shop are provided “as is” and “as available.”
  • Damage Limitation: In no event shall SmallOutboardMotors.shop, its owners, directors, officers, or employees be liable for any direct, indirect, incidental, punitive, or consequential damages arising from:
    • Improper installation or operation of any outboard motor.
    • Operation of an engine without proper fluids or cooling water.
    • Watercraft accidents, personal injury, or property damage resulting from engine use or failure.

8. INTELLECTUAL PROPERTY

All content on SmallOutboardMotors.shop—including logos, branding, text, graphics, images, product descriptions, and site code—is the property of Small Outboard Motors and is protected by copyright, trademark, and intellectual property laws. Reproduction, redistribution, or resale of site assets without express written consent is prohibited.

9. GOVERNING LAW

These Terms and Conditions and any separate agreements under which we provide you services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
